Terms and conditions of sale

Who we are

Luso Kitchen is a fresh Portuguese food delivery service, run by Delipo, a family catering business based in Orvin, in the canton of Bern. By ordering on lusokitchen.ch, you accept these terms and conditions of sale. We may update them at any time. The version in force at the time of your order is the one that applies.

Our dishes

We cook fresh Portuguese dishes by hand. The menu changes every week: it offers 4 to 6 dishes drawn from a rotating catalogue. The photos on the site are illustrations, the actual look of the dishes may vary. If a dish is unavailable, we may replace it with a similar dish at the same price or refund you for it.

Ordering

You can order until Sunday at midnight for delivery the following Tuesday. Your order is final once paid. Check your details, especially your address and phone number, before confirming: production starts right after the order deadline. Sales are restricted to people aged 18 and over, for normal household quantities. Reselling is not allowed.

Prices and payment

Prices are shown in Swiss francs. Those displayed at the time of your order apply. Payment is by Stripe only, at the time of ordering. Your card details are processed by Stripe: we never see your full number, only the card type, the last 4 digits and the expiry date. An unpaid order is not prepared.

Delivery

We deliver on Tuesdays, ourselves, only in the areas we serve. The site checks your postcode at checkout: if your area is not served, ordering is impossible. Give an exact address and stay reachable. If you are absent, the parcel may be left at your door or following your instructions. From the moment it is left, the risk of theft, damage and breaking the cold chain passes to you. If delivery is impossible, for example because of a wrong address, absence or no access to the building, the order remains due and cannot be re-delivered free of charge, as the dishes are perishable.

Storing the dishes

Our dishes are fresh: put them in the fridge as soon as you receive them. They keep for 3 to 5 days in the fridge depending on the dish, see the label, or up to 3 months in the freezer. The use-by date on the label only holds if the cold chain was respected. Luso Kitchen accepts no liability if these instructions are not followed.

Allergens

Our dishes are prepared in a kitchen that handles many ingredients: gluten, eggs, milk, nuts and many more. Despite the care we take in preparation, traces of allergens remain possible. Allergens are listed for each dish on the site. If you have a severe allergy, contact us via the contact form before ordering. Nutritional information is indicative and does not replace medical advice.

Cancellation, returns and refunds

You can cancel or change your order until Sunday at midnight, before production starts, via the contact form. After that, the order is final. In Switzerland, there is no statutory right of withdrawal for online purchases. Because the dishes are perishable, no return or exchange is possible. If Luso Kitchen has to cancel your order on its side, you get a full refund.

Complaints

If a dish is missing, damaged or not as described, contact us via the contact form within 12 hours of delivery, ideally with a photo. After checking, we replace the dish or refund it. Beyond 12 hours, given the perishable nature of the products, no complaint can be accepted.

Liability

Luso Kitchen is liable for direct damage it causes, up to the amount of the relevant order. It is not liable for indirect damage. The cases where the law does not allow liability to be limited remain reserved: personal injury, fraud or gross negligence, liability for defective products. Luso Kitchen is not responsible for the consequences of failing to follow storage instructions or allergen information.

Data protection

Our privacy policy, available on the site, explains what data we collect and why. We encourage you to read it to understand how your data is handled.

Governing law and jurisdiction

These terms are governed by Swiss law. Any dispute goes to the courts at Delipo’s registered office in Orvin (canton of Bern). If a clause turns out to be invalid, the rest of the terms remains in force. If the language versions differ, the French version prevails.
